Copyright Policy

Battle It Out respects copyright. Users must only upload video and audio they created or have permission to use. This page is our copyright and DMCA takedown policy, including how to notify our designated agent.

1. Music and audio rule

You may only upload video you created, with audio you have the right to use: original audio, audio you licensed, or audio that is otherwise legally available for this use.

Do not upload commercial tracks, movie or TV clips, sports broadcasts, or someone elseâs performance unless you have permission. Dance, comedy, and music battles are not an exception.

2. How we handle infringement (takedown)

We may remove or disable access to material that appears to infringe copyright, including after a user report or a rights-holder notice that substantially complies with 17 U.S.C. Â§ 512(c)(3). When we remove material in response to a valid notice, we will try to notify the uploader if we have a working email for that account. Repeat infringers may lose their account. Submitting a battle requires you to confirm you have the rights to the video and audio.

A complete notice is not a guarantee of any particular outcome, but we act on valid notices as quickly as we reasonably can, and we treat complete DMCA notices as high priority (same-day when we can, and within 24 hours as a target).

3. Designated DMCA agent

To send a copyright infringement notice, contact the designated agent below. For the U.S. statutory safe harbor, the same agent information must also appear in the U.S. Copyright Office DMCA Designated Agent Directory. Registration is done by the operator at dmca.copyright.gov (it cannot be completed from the mobile app). Alternate names that should appear in that directory include Battle It Out, battle-it-out.com, battleitout.app, and com.battleitout.app.

4. File a copyright complaint

Email support@battleitout.app with the subject Copyright Complaint (or mail the designated agent) and include all of the following, which tracks 17 U.S.C. Â§ 512(c)(3):

Your legal name, mailing address, phone number, and email
A description of the copyrighted work (for example, the song title and artist, or the film title)
The Battle It Out URL, username, or battle/video ID where the material appears
A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law
A statement that the information in the complaint is accurate, and that you are the owner or authorized to act for the owner, under penalty of perjury
Your physical or electronic signature

5. Counter-notice

If we removed your content and you believe it was a mistake or fair use, email the same address with the subject Copyright Counter-Notice. Include your name and contact information, identification of the content that was removed and where it appeared, a statement under penalty of perjury that you have a good-faith belief it was removed or disabled by mistake or misidentification, consent to the jurisdiction of the Federal District Court for the judicial district where your address is located (or for any U.S. judicial district if you are outside the United States), consent to accept service of process from the original complainant, and your signature.

If we receive a complete counter-notice, we will send it to the original complainant. We may restore the material not less than 10 and not more than 14 business days later, unless the complainant notifies us that they have filed a lawsuit seeking to keep the material down (17 U.S.C. Â§ 512(g)).

6. Repeat infringers

We keep records of valid copyright removals. As a guideline: one valid complaint can result in removal and a warning; a second can result in a short feature limit or a further warning; a third can result in account termination. We may skip steps for egregious or obvious infringement. A valid DMCA notice counts even if nobody used in-app Report.

7. Misrepresentation

Under 17 U.S.C. Â§ 512(f), anyone who knowingly materially misrepresents that material is infringing (or that it was removed by mistake) may be liable for damages. Do not send a notice unless you have the rights you claim.
