Welcome to Battle It Out. By creating an account or using the app, you agree to these Terms of Service, our Community Guidelines, our Copyright Policy, and our Privacy Policy.
1. Eligibility
You must be at least 13 years old to use Battle It Out. If you are under 18, you confirm you have permission from a parent or guardian where required by law.
2. Your Account
- You are responsible for activity under your account
- Provide accurate registration information
- Keep your login credentials secure
- You may delete your account at any time in Settings
3. User Content & Battles
You retain ownership of content you upload, but grant Battle It Out a worldwide, non-exclusive license to host, display, distribute, and use that content as needed to operate the service (including feeds, battles, voting, notifications, and marketing of the platform).
You are solely responsible for the content you post. Do not upload content that infringes othersâ rights or violates these Terms or the Community Guidelines.
4. Music, Audio, and Copyright
You may only upload video you created, with audio you have the right to use: original audio, audio you licensed, or audio that is otherwise legally available for this use.
Do not upload commercial tracks, movie or TV clips, sports broadcasts, or someone elseâs performance unless you have permission. We may remove infringing content and suspend repeat offenders. Copyright complaints are handled under our Copyright Policy.
5. Community Rules
You must follow the Community Guidelines. In short, you agree not to:
- Post illegal, hateful, harassing, sexually exploitative, or violent content
- Upload unlicensed commercial music, movie clips, or other peopleâs content
- Impersonate others or misrepresent your identity
- Spam, manipulate votes, or abuse reporting tools
- Attempt to disrupt, reverse engineer, or compromise the service
- Use the app for unauthorized commercial scraping or bots
We may remove content, restrict features, or suspend/terminate accounts that violate these rules.
6. Reporting & Safety
Use in-app reporting and blocking tools to flag harmful behavior. We review reports and take action we believe is appropriate, but we do not guarantee removal of every reported item.
7. Intellectual Property
The Battle It Out name, branding, and app software are owned by us or our licensors. You may not copy or reuse them without permission. If you believe content on the service infringes your copyright, follow the Copyright Policy.
8. Third-Party Services
The app relies on third-party services (including Firebase, Cloudinary, Google Sign-In, and Sign in with Apple). Your use of those features may also be subject to those providersâ terms.
9. Disclaimers
Battle It Out is provided âas is.â We do not guarantee uninterrupted service, uninterrupted uptime, or that content from other users will be accurate or appropriate.
You understand that the app hosts user-generated videos, comments, messages, profiles, and votes. We do not endorse user content. Other usersâ posts are their responsibility. We may, but are not obligated to, monitor or remove content.
10. Limitation of Liability
To the maximum extent permitted by law, Battle It Out and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the service, including from user-generated content, votes, challenges, or account actions.
To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or the service is limited to the greater of (a) the amount you paid us (if any) in the 12 months before the claim or (b) one hundred U.S. dollars (US $100). This version of the app does not charge for access.
Some places do not allow certain liability limits. If those laws apply to you, some of the limits above may not apply, and you may have additional rights. These Terms do not limit liability that cannot be limited under applicable law (for example, liability for fraud or for death or personal injury caused by negligence, where that bar is not allowed).
11. Your responsibility (indemnity)
You agree to defend, indemnify, and hold harmless Battle It Out and its operators from claims, damages, and reasonable legal fees arising out of content you upload, your violation of these Terms or the law, or your infringement of someone elseâs rights, including copyright and publicity rights. We will try to notify you of a covered claim if we have a working email for your account.
12. Copyright complaints
If you believe content on Battle It Out infringes your copyright, follow the Copyright Policy. We may remove material and, where appropriate, terminate repeat infringers. Designating a DMCA agent with the U.S. Copyright Office is how U.S. hosts seek the statutory safe harbor in 17 U.S.C. § 512; the public agent listing must match that directory.
13. Informal resolution, arbitration, and class-action waiver
Apple and Google do not require arbitration. This section is a contract between you and us. It does not stop you from reporting a problem to Apple, Google, or a government agency (including the U.S. FTC). It also does not apply to the extent a law in your country forbids arbitration of consumer disputes.
Before filing a claim, email support@battleitout.app with the subject Dispute Notice, your account email, and a description of the issue. We will try to resolve it for 30 days.
If we cannot resolve it and the claim is not in small-claims court, you and we agree to binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The AAA consumer rules are published at adr.org. One arbitrator will decide. The arbitration may be by phone, video, or papers unless the arbitrator orders a hearing. The arbitrator may award individual relief a court could award, including injunctive relief for you alone.
You and we waive any right to a jury trial and to participate in a class, collective, or representative action. Claims may be brought only in an individual capacity. If this class-action waiver is found unenforceable for a particular claim, that claim must proceed in court and not in arbitration.
Either of us may instead bring an individual claim in small-claims court in a jurisdiction that can hear it.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@battleitout.app with the subject Arbitration Opt-Out and the email on your account. Opting out does not affect the rest of these Terms.
This arbitration section is governed by the Federal Arbitration Act. If a part of this section is found unenforceable, the rest remains in effect, except as stated for the class-action waiver.
14. Governing law
These Terms are governed by the laws of the United States and the state where Battle It Out maintains its principal place of business, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply instead. The specific state will be the state of that principal place of business.
15. Changes
We may update these Terms from time to time. Continued use of the app after changes become effective means you accept the updated Terms.
